Consumer forum penalizes insurer to pay Rs 7.23L to bizman

Dehradun: Dehradun District Consumer Redressal Forum has ordered the United India Insurance Company Limited to shell out Rs 7, 23,900 as compensation to a city businessman for deficiency of service by not granting an insurance claim made against a theft occurred at the complainant's shop.

The complainant, Rajesh Goyal claimed that he took a Rs 15-lakh insurance policy from the insurance company and was regular in paying the premium. He claimed that a major theft took place at his photography shop, located at Chakrata Road, on the intervening night of September 8th and 9th in 2008 for which he registered an FIR at the police station.

The insurance company estimated the total cost of missing stock from the shop at Rs 3,27,338 while on contrary, according to the police FIR, the total loss amounted to Rs 7,08,900.

The consumer forum found the insurer guilty of underestimating the amount of loss and raised questions over the survey report of insurance company. The forum hence passed an order asking the insurance company to pay Rs 7,08,900 as claim amount, besides a compensation of Rs 10,000 towards the agony caused by deficiency of service. The company has also been directed to Rs 5000 towards the cost of litigation.
